Southern Response could be on the line for billions of dollars after a “significant” Premium Court ruling will allow thousands of Canterbury home owners to proceed with a course action against the government insurer.
The class action, that typically consisted of about 3000 home owners so was represented by Christchurch twosome Brendan and Colleen Ross, plausible government insurer Southern Response misled them by giving incomplete information about the associated with remedying damage to their homes after the Canterbury earthquakes.
If successful, it was estimated the students action could cost the government vast sums of dollars.
Today’s decision in the Supreme Médiocre was the final chapter of a judicial battle over whether the class experience would proceed on an “opt-in” also “opt-out” basis.
An “opt-in” class action, currently the legal norm, was favoured while Southern Response. In this case, people would have to consciously “opt-in” to the class step.

Typically the Court of Appeal agreed numbers that the class action could be “opt-out”, which Southern Response appealed preference Supreme Court.
Today, that appeal was ignored.
Grant Cam, of GCA Lawyers, was symbolizing the class action and said the modern day decision was “very significant” to would help ensure that “people know more about justice”.
He or said today’s decision in the Supreme Court was the right one.

“Instead of having 10 per cent [of a potential class] being paid out and simply recover what they are entitled to, everybody will have to be entitled to recover – in this case, the minister Megan Woods suggested the liability could be about $500m, ” the dog said.
